These Terms of Use (the "Terms") govern access to and use of the website yashor.com and the application "Letter to Burn" / "Carta para quemar" (the "app"). By accessing or using the site or the app, you declare that you have read and accepted these Terms. If you do not agree, do not use them.
The site and the app are provided by Jossué Gálvez, an individual domiciled in the Republic of Ecuador, owner of the yashor brand. Contact: yashor.health@outlook.com.
"Letter to Burn" is a wellbeing and self-help tool: a private space to write what weighs on you and then symbolically "burn" it on screen. It is built on principles from psychology; what you write exists only during the session and is not kept anywhere.
Important notice. The app is a wellbeing support tool and does not constitute therapy, treatment, diagnosis, or medical, psychological or professional advice of any kind. It does not create a doctor–patient relationship and does not replace the care of a mental health professional.
If you are going through a crisis or have thoughts of harming yourself, seek help immediately: contact a health professional, an emergency service in your area, or someone you trust. Use of the app does not replace such help.
You acknowledge and accept that: (i) the app is a self-help tool and not a healthcare service; (ii) you freely decide how and when to use it, and you are solely responsible for the decisions and actions you take; and (iii) you use the app at your own risk. We do not guarantee any particular result or effect.
You agree to use the site and the app only for personal and lawful purposes. The following is prohibited, by way of example and without limitation: copying, reproducing, redistributing, reselling or exploiting the app or its content; reverse-engineering or attempting to breach its operation or security; and using it in any way that infringes the law or third-party rights.
When available, the app will be offered as a one-time payment through the App Store (Apple) and Google Play (Google). Charging, billing and refunds are governed solely by the policies of those platforms. We do not process your payments nor handle refunds directly.
By acquiring or using the app through the App Store or Google Play, you are also subject to those platforms' terms, conditions and end-user license agreements (EULAs), which apply in addition to these Terms.
The app, the yashor brand, the name "Letter to Burn" / "Carta para quemar", as well as its texts, code, design and graphic elements, are owned by Jossué Gálvez and protected by applicable intellectual property laws. No right is granted to copy, modify, distribute or commercially use them without prior written authorization.
The site and the app are provided "as is" and "as available," without warranties of any kind, express or implied, including — without limitation — warranties of merchantability, fitness for a particular purpose, uninterrupted availability, or the achievement of any specific result.
To the maximum extent permitted by applicable law, Jossué Gálvez shall not be liable for any indirect, incidental, special, punitive or consequential damages, nor for loss of data, profits or any other loss, arising from the use of or inability to use the site or the app. In any case, our total aggregate liability to you is limited to the amount you paid for the app and, if you made no payment, to zero (USD $0).
You agree to hold Jossué Gálvez harmless from any claim, loss or expense (including reasonable attorneys' fees) arising from your misuse of the site or app, or from your breach of these Terms.
You declare that you are of legal age (18) or have your legal guardian's authorization to use the service. The service is not directed to minors under 18.
The processing of your data is governed by our Privacy Policy, which forms an integral part of these Terms.
We may modify, suspend or discontinue the site or the app, in whole or in part, at any time. We may also update these Terms; changes will be posted on this page with the date of update, and continued use implies acceptance.
If any provision of these Terms is held invalid, void or unenforceable by a competent authority, that provision shall be interpreted or replaced to the extent necessary, and the remaining provisions shall remain in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Jossué Gálvez regarding the site and the app, and supersede any prior agreement or understanding on the matter.
These Terms are governed by the laws of the Republic of Ecuador, and any dispute shall be submitted to the competent courts of Ecuador. The Spanish version is the official and prevailing version; this English translation is provided for convenience and, in case of any discrepancy, the Spanish text shall prevail.
